By accessing or using the Hybrid Dad mobile application and website (collectively, the "Service"), operated by Activate Software, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Hybrid Dad is a fitness coaching platform that allows:

• Coaches to create workout programs, manage clients, share exercises, and generate AI-powered training plans.
• Students to view assigned workouts, log sessions, track progress, earn achievements, and participate in challenges.
• Admins to manage users, exercises, categories, and challenges across the platform.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your login credentials secure and confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorised use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload or share content that is harmful, offensive, or infringes on others' rights
• Attempt to gain unauthorised access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape, crawl, or collect data from the Service
• Impersonate any person or entity, or misrepresent your affiliation

5. User Content

You retain ownership of content you create and upload to the Service, including workout programs, exercises, progress photos, and journal entries. By using the Service, you grant us a limited licence to store, display, and process your content as necessary to provide the Service.

You are solely responsible for the content you upload and share through the Service. We do not endorse or guarantee the accuracy of any user-generated content.

6. Coach-Student Relationships

The Service facilitates connections between coaches and students. Please note:

• Hybrid Dad is a platform tool and does not verify coach qualifications or certifications
• Coaches are solely responsible for the workout programs and advice they provide
• Students should consult a healthcare professional before beginning any fitness programme
• We are not liable for any injury or harm resulting from workouts performed using the Service

7. AI-Generated Content

The Service uses artificial intelligence (OpenAI) to generate workout suggestions and recommendations. AI-generated content is provided for informational purposes only and should not be considered professional medical or fitness advice. Always use your own judgement and consult qualified professionals when needed.

8. Intellectual Property

The Service, including its design, features, code, and branding (excluding user content), is owned by Activate Software and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Activate Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
